As outlined in the 2019 Novogradac & Company and Snell & Wilmer Key Note Presentation given by attorney Marc Schultz, and Brent Parker, CPA, at the State of Hawaii Department of Business, Economic Development & Tourism seminar I attended, there are three tax incentive benefits:
- Temporary deferral of the eligible gain which applies to any capital gain from the sale or exchange of any property.
- Partial reduction of deferred gain. Income tax is still paid on a large portion of the deferred gain.
- Forgiveness of additional gain applies to the appreciation in the Opportunity Fund investment.
