Staking vs. Survey When Purchasing Property in Hawaii

When buying property in Hawaii, one important step many buyers overlook is the property survey. Understanding the difference between a staking (C-41) and a full survey (C-42) can help you avoid costly surprises before closing.

What Is a Property Survey in Hawaii?

A property survey is used to confirm boundary lines, identify structures, and detect any encroachments or issues that could affect ownership or use of the land.

What Is a C-41 Staking?

A C-41 staking is the more basic option. A surveyor will visit the property and mark the boundary corners so they are visible. However, staking does not include a map or detailed documentation, which limits how much information the buyer receives.

A surveyor will visit the property and verify that the boundary corners are accurate. They will be clearly marked for the purchaser to see. No map will be provided.

What Is a C-42 Survey?

In a C-42, the surveyor will not only verify boundary corners, but will also prepare a map of the property. Structures along the boundary will be located. If there are any encroachments, this will be visible on the map. By acknowledging the encroachments at this point, the ownership of the structures can be determined, and any issues addressed and handled before the closing.

  • C-42 Survey: Full map + boundary + structures + encroachments

In most cases, a C-42 survey provides significantly more protection for the buyer.

Why a Full Survey Matters When Buying Property

Without a full survey, buyers may not discover boundary issues or encroachments until after closing—when they become much more difficult and expensive to resolve.

Cost of a Property Survey in Hawaii

The cost of a staking or survey in Hawaii varies based on property size, terrain, and complexity.

  • Staking (C-41): typically lower cost
  • Full survey (C-42): higher cost due to detailed mapping

While prices vary, many buyers find the additional cost of a full survey well worth the added clarity and protection.

Who Pays for the Survey?

Typically, the seller will pay for the survey to be performed, but in this market with so many REO properties, it’s not unusual for the seller (the bank in most of these cases) to refuse to pay. Regardless of who’s paying, the peace of mind that the survey provides is worth the money.

Which Should You Choose?

As a general rule, I recommend that buyers choose a C-42 full survey whenever possible. The additional detail provides peace of mind and helps avoid surprises that could impact ownership or future resale.

This is good information. In todays market with what seems like distressed properties, REO’s and Short sales dominating the market, it might be a good idea to remind buyers that this could be a cost they will have to consider. But for the small investment, it’s well worth the peace of mind.

If I am on a Hawaiian Homes leased land and surrendering my lease back to them, am I responsible to pay for a C-42 survey? The survey was done prior to my purchasing the house just 3 yrs ago.
